Edison Property Beats Condemnation, Welcomes 85°C Bakery

A once-embattled property at 1810 Route 27 in Edison, New Jersey, has overcome a condemnation threat and is now moving forward with redevelopment plans, welcoming the popular 85°C Bakery as its anchor tenant.

The property had been slated for condemnation by the Edison Township Council as part of a larger redevelopment initiative. However, the property owner, 1810 rte 27 llc, challenged the decision in court, arguing that they had already secured plans to redevelop the site.

Attorney Richard Schkolnick, represented the owner of the 25,000-square-foot property at 1810 Route 27, stated that his client purchased the property in March 2021 and had been working to clean up the site for redevelopment. He emphasized, “This case highlights the formidable governmental power of eminent domain, where private property is forcibly taken against the owner’s wishes and transferred to another private entity for redevelopment.” Schkolnick further noted that the property is not being acquired for public use, such as a school, park, or road.

In June of 2023, Councilman Richard Brescher expressed concerns about taking away people’s rights to own and choose what to do with their property. “The property owners are in the process of developing the property, it doesn’t make sense that Mayor Joshi wants to condemn it. I can see more costly litigation on the horizon.”

The legal battle ultimately concluded in favor of the property owner, clearing the path for the transformation of the site. The plans include the demolition of the existing structure and the construction of a new 7,000-square-foot building with 38 parking spaces.

The centerpiece of the development is the 85°C Bakery, a Taiwanese chain known for its wide array of pastries and beverages. With over 1,000 locations worldwide, the bakery has garnered a loyal following and is expected to be a popular addition to the Edison community.

The bakery’s presence at 1810 Route 27 represents a significant victory for the property owner and a testament to the power of private development. It also highlights the importance of collaboration between property owners and local officials to achieve mutually beneficial redevelopment goals.
