    Default Approval Looms for 4-Story Building on Amboy Ave

    A proposed 4-story building on Amboy Ave in Edison Township is inching closer to reality due to a potential default approval. The developer, A&D Holdings LLC, has claimed approval for their final site plan application affecting Lot 1.03, Block 727, citing the Township Planning Board’s failure to act within the statutory timeframe.

    The notice, published on Sunday, August 25, 2024, and signed by Larry Lavender Esq. of Wiley Lavender Maknoor A Professional Corporation, states that A&D Holdings LLC is entitled to approval because the Planning Board did not grant or deny their application within the legally mandated period. This could pave the way for the construction of the building, despite potential concerns from residents or the board itself.

    The situation underscores the importance of timely decision-making in land use planning. Delays can lead to default approvals, potentially resulting in developments that might not align perfectly with the community’s vision or the board’s preferences.

    The future of the proposed development now hangs in the balance. It remains to be seen whether the Township Planning Board will challenge the default approval claim or whether A&D Holdings LLC will proceed with their plans for the 4-story building on Amboy Ave.
